Definitions of Common Motor Vehicle Dealer Words

Dealer: A person engaged in the business of buying, selling, exchanging, offering to negotiate, negotiating, or advertising the sale of a vehicle or industrial equipment.

Equipment Dealer: A person engaged in the manufacturing or buying and selling of: farm tractors with engines in excess of 40 horsepower, farm equipment, construction vehicles or equipment, or industrial vehicles or equipment. Unless otherwise prohibited, equipment dealer plates may be attached only for demonstration, emergency, and service purposes.

Who Should Apply to Be a Motor Vehicle Dealer

A person is "engaged in the business of buying, selling, exchanging, offering to negotiate, negotiating, or advertising the sale of vehicles" if that person:

  • buys vehicles for the purpose of resale;
  • sells more than five vehicles in any 12-month period; or
  • advertises, in any form, three or more vehicles for sale or displays three or more vehicle for sale within a 30-day period on premises controlled by that person.

Vehicles owned and registered by that person for at least six months are not included for purposes of this definition.

Motor Vehicle Dealer Licensing

The Dealer Section issues and maintains the records of licensed dealers in the state and the plates associated with those licenses. The section provides information on the requirements to obtain a dealer's license and the laws, rules and regulations to maintain the license.

Dealer licenses expire on the last day of the month one year from issuance.
