Section 40, Home Health Services: Reimbursing Parents Providing Home Health Aide (HHA) Services

The Office of MaineCare Services (OMS) provides the following guidance to service providers and interested parties in accordance with LD 346, which requires OMS to reimburse parents providing Home Health Aide (HHA) services to eligible minor children under MaineCare Benefits Manual (MBM), Section 40, Home Health Services.

After reviewing Section 40 (Chapters II and III), and consulting with the Centers for Medicare and Medicaid Services (CMS), OMS has determined that there are no provisions currently preventing qualified parents from providing reimbursable Home Health Aide (HHA) services to their eligible minor children. Home Health Services providers may seek reimbursement for HHA services delivered by parents to their eligible minor children who are certified as HHAs as outlined in Section 40.   

OMS plans to initiate the Administrative Procedures Act (APA) rulemaking in the near future to formalize this guidance.
