Toxics Use Reduction Program (TUR)
Department rule Chapter 81 identifies five Priority Toxic Chemicals and Chapter 82 contains requirements for manufacturers to report their use of those chemicals.
Chapter 81 priority toxic chemicals:
- formaldehyde
- cadmium
- hexavalent chromium
- perchloroethylene
- trichloroethylene
Manufacturers in the State of Maine using more than 1,000 pounds annually of any of Maine’s five priority toxic chemicals must file a use report with the Department by July 1 each year, and must develop a pollution prevention plan specific to these chemicals.

Exemptions
The Department may exempt classes of facilities and specific uses of priority toxic chemicals by commercial and industrial facilities from these requirements, if the department determines that:
- no reasonably available safer alternative exists;
- that the chemical is naturally occurring; or
- that application of this chapter is unlikely to result in the reduction of the use of the priority toxic chemical.
Laboratory chemicals used to perform experimental, quality assurance or investigative procedures may be exempt.
Naturally occurring priority toxic chemicals may be exempt if certain criteria are met.
