Attention Section 18, 20, 21, and 29 Providers – Appendix K Retainer Payments for newly eligible service providers

The Department is issuing payments this week to providers of select eligible services under Sections 18, 20, 21, and 29 newly eligible for Home and Community-Based Services (HCBS) Appendix K Retainer Payments.

The Centers for Medicare & Medicaid Services has approved changes to the State’s original provider eligibility criteria for these Retainer Payments. Information regarding the original process and criteria for Retainer Payments went out in e-messages on May 13, 2022, September 24, 2021, and August 30, 2021. Revised eligibility criteria and the process for newly eligible providers were outlined in May 12, 2022, guidance from the Office of Aging and Disability Services. The Department modified Retainer Payment attestation requirements regarding staff layoffs (#4 within the attestation form) so that providers could still qualify even if they laid off staff during the retainer period of October through December 2020.

The payments will be issued on July 14, 2022. The date of receipt depends on individual provider’s payment format and bank arrangements.

The Department is making these one-time payments automatically, based on the reopened application and attestation process outlined in the May 12, 2022, guidance from the Office of Aging and Disability Services. The payments will be indicated as an “OTHER” payment on the Summary page of the paper remittance advice (RA).
