TANF Rule #122A – Mileage Reimbursement Update

The adopted rule updates Chapter V – B, TRANSITIONAL TRANSPORTATION (TT) consistent with the rate afforded to those covered under the Maine Service Employees Association (MSEA) contract. The adopted rule refers readers to the MSEA rate found at https://www.maine.gov/osc/travel/mileage-other-info.

The adopted rule updates Chapter V – B(4)(b) to: “Effective January 1, 2025 mileage is reimbursed consistent with the State of Maine mileage reimbursement rate set by the Department of Administrative and Financial Services Office of the State Controller found at https://www.maine.gov/osc/travel/mileage-other-info.”

(B)(4)(c) is updated to “TT mileage reimbursement shall not exceed $20 per day.”

Retroactive rulemaking is permissible under 22 M.R.S. § 42(8)(C) as this update provides a benefit to TANF recipients as the adopted rule change raises the mileage reimbursement rate from .46 cents to .54 cents and from .56 cents to .64 cents for individuals with disabilities.

This rule will not have an adverse impact on municipalities or small businesses.
