In accordance with § 2430-I of the Maine Medical Use of Cannabis Act (MMUCA), OCP may impose an administrative penalty; seize and destroy cannabis or cannabis products; and suspend or revoke a registry identification card or registration certificate for a violation. Registration violations are broken down into three categories:
- Minor registration violations
- Major registration violations
- Major registration violations affecting public safety
Examples of each registration violation are included in 22 M.R.S. § 2430-I(1-A). Fines associated with each category of registration violation are assessed based upon the registration type of the person found to be in violation of program requirements, with “registrants” (registered caregivers, dispensaries, cannabis testing facilities, manufacturing facilities, and persons authorized to engage in cannabis extraction using inherently hazardous substances) subject to a maximum monetary penalty of $7,500 per registration violation. Caregivers that do not operate a retail store and “registrant agents” (an assistant, employee, officer, director, or other authorized agent of a registrant) are subject to a maximum monetary penalty of $1,500 per registration violation.
Prior to the implementation of P.L. 2023, ch. 365 (effective October 25, 2023) the MMUCA permitted the State to seek a civil judgment imposing fines in very limited circumstances. In 2023, and again in 2024, the Legislature expanded availability of compliance tools beyond suspension or revocation of a registrant’s OCP-issued credentials, so the historical records available here should be understood in that context.
Terminology
A registry identification card (RIC) is a document issued by OCP that identifies a person as a person who has registered with OCP. Each type of registry identification card is based upon an OCP approved application and authorizes specific conduct. Registry identification cards include:
- CGR – Caregiver registry identification card
- RIC – Registry identification card
- CGE – Caregiver assistant registry identification card (this type of registry identification card is no longer issued by OCP)
A registration certificate is a document issued by OCP that identifies an entity as an entity that has registered with OCP. Each type of registration certificate is based upon an OCP approved application and authorizes specific conduct. Registration certificates include:
- DSP – Dispensary registration certificate
- LTC – Long-term care facility registration certificate
- MHX – Cannabis manufacturing facility (individual) authorized to engage in inherently hazardous extraction
- MHC – Cannabis manufacturing facility (business entity) authorized to engage in inherently hazardous extraction
A Notice of Administrative Action is issued when OCP takes final agency action by imposing a monetary administrative penalty or suspending or revoking a registry identification card or registration certificate. The registrant may have an opportunity to engage with OCP to reach a mutual agreement, known as a Settlement Agreement. If not timely appealed, the Notice takes effect.
Violation Data
The following table summarizes violation data for the Maine Medical Use of Cannabis Program (MMCP) from OCP’s February 2019 inception through October 2024. This information will be updated at the beginning of each quarter.
- Date – The date of the final agency action
- Registrant – Either the natural person or business entity holding the registration
- Registration Number – OCP’s unique identifier for each registration type
- Action – Monetary penalty, suspension or revocation
- Settled Fine Amount – The settled fine amount agreed upon by OCP and the registrant
- Final Action Documentation (Redacted) – The final agency action, whether a Notice of Administrative Action or Settlement Agreement

Finally, starting in the Spring of 2022, this Office began the process of rebranding to the Office of Cannabis Policy (OCP). The name change was necessitated, in part, by the passage of P.L. 2021, ch. 669 which replaced the term “marijuana” with “cannabis” in most portions of state law. As a result, notices and decisions issued before that change use the terms “marijuana” and “Office of Marijuana Policy” instead of “cannabis” and “Office of Cannabis Policy”.
