What is an Individual Identification Card?

The Individual Identification Card Application is an official document. Providing false information and/or failing to disclose all required information is grounds for denial of a Maine Adult Use Individual Identification Card.

The Office of Cannabis Policy cannot provide legal advice; if the applicant has questions regarding the interpretation of statute and/or rule, the applicant should seek legal counsel.

Who Needs an Individual Identification Card?

All individuals working in or for a licensed cannabis establishment who possess, cultivate, manufacture, package, test, dispense, transfer, serve, handle, transport or deliver cannabis or cannabis products are required to have an Individual Identification Card.

All individuals working in or for a licensed cannabis establishment who have the authority to access or input data into the inventory tracking system or a cannabis establishment point of sale system are required to have an Individual Identification Card.

All principals (including but not limited to officers, directors, managers, or general partners) of a licensed cannabis establishment are required to have an Individual Identification Card.

Useful Application Definitions:

Principal:

     A. A natural person operating as a sole proprietor;

     B. The officers of a corporation organized pursuant to Title 13-C who have authority to manage, direct or oversee the applicant's or licensee's operations, if the applicant or licensee is a corporation;

     C. The directors of a corporation organized pursuant to Title 13-C, if the applicant or licensee is a corporation;

     D. The shareholders of a corporation organized pursuant to Title 13-C, if no officers or directors are appointed and the applicant or licensee is a corporation;

     E. The general or limited partners of a partnership organized under Title 31, chapter 19, if the applicant or licensee is a partnership;

     F. The nonmember managers or managing members of a limited liability company organized under Title 31, chapter 21, if the applicant or licensee is organized as a limited liability company; and Page 25 - 131LR0543(05)

     G. Any other natural person to whom the applicant or licensee has given authority to manage, direct or oversee the applicant's or licensee's operations.

If an officer, director, shareholder, partner, manager or member under paragraph B, C, D, E or F is a business entity, "principal" means any natural person to whom the business entity has given authority to manage, direct or oversee the applicant's or licensee's operations.

"Principal" does not include those persons whose managerial responsibilities are limited to staff supervision and who are not authorized to act on behalf of the applicant or licensee. For purposes of this subsection, "operations" does not include human resources, information technology, marketing or accounting and finance.

Court-Ordered Payments: Any court-ordered payment, including but not limited to court fines, fees, and restitution, child support obligations, and attorney’s fees.

Required Additional Application Materials:

Photograph: A clear image of your face. Do not use filters commonly used on social media. Do not digitally change your photo. Have someone else take your photo. Use a plain white or off-white background. A high-resolution photo that is not blurry, grainy, or pixelated. Photo must be 2 x 2 inches.

Tips for Faster Processing:

Applicants are encouraged to submit an application electronically (https://licensing.web.maine.gov/cgi-bin/online/licensing/begin.pl?board_number=421) in order to expedite the application process.

Applicants are encouraged to upload their photo and Release of Information form electronically in order to expediate the processing of their application.

Applicants should review the statute and rules (https://www.maine.gov/dafs/ocp/adult-use/rules-statutes) to determine requirements.

Applications will not be processed until the licensing fee has been received.

Application Steps for an Adult Use Individual Identification Card:

  1. Applicant begins the application process electronically or in paper form. (You are encouraged to submit your application electronically in order to expedite the application process. You are also encouraged to gather and prepare the required application materials for upload during this stage of the electronic application process. However, you will have the ability to upload required outstanding application materials later in the application process using the “Upload Outstanding Application Materials” webpage.)
  1. After the applicant submits the application, the applicant will receive an email notification with the pending license number, electronic access code, and Notice of Application Fee with instructions for next steps.
  1. If any required application materials are outstanding, applicant will upload materials using the “Upload Outstanding Application Materials” webpage.
  1. Upon receipt of application fee, the Office of Cannabis Policy will review the application to determine if the Office is in possession of all required documents.
  1. Upon completion of processing the application materials and verification of the Character and Fitness questions, the Office of Cannabis Policy will notify the applicant by email of the Office’s decision on the Individual Identification Card.
  1. If denied, the Office will notify the applicant in writing of the denial, the basis for the denial and the applicant's right to appeal pursuant to the Maine Administrative Procedure Act.
  1. If approved, the applicant will receive an Individual Identification Card by United States Postal Service first class mail.

Renewal of an Adult Use Individual Identification Card

The Office will email the licensee, to the email address on file, sixty day before expiration of the Individual Identification Card inviting licensee to start the renewal process.

A Release of Information form is required each year.

A new photo will be required every 10 years.

If a renewal is not processed by the expiration of the current Individual Identification Card, the renewal application is closed, the current Individual Identification Card become expired, and the licensee must then submit a new application. To avoid this, be sure to submit the renewal application and required materials at least 30 days before the expiration date of the Individual Identification Card.

Fees 

Individual Identification Card: $50

Cash and personal checks are not accepted by the Office of Cannabis Policy. Please submit a bank/cashier's check or money order made payable to “Treasurer, State of Maine.” All fees are non-refundable.
