Notary Public is an ancient office dating back before the Roman Empire. American pioneer history is replete with examples of notarial assistance. Among them: the processing of land or mining claims, the authentication of public or private documents, and the reading and writing of general correspondence. Since that time, the official duties and significance of American Notaries Public have expanded considerably, largely through statutes enacted by the states. More than simply a scrivener, the Notary Public of today acts as a liaison between the government and its citizens; facilitating the authorization of numerous important transactions. Today in Maine, the need for notarial services is cited throughout Maine law. Notaries Public have duties and responsibilities that confer upon them the trust and faith of the public. Notaries Public are authorized to perform certain official duties that are critical to those who need them. The primary duty is to formally witness transactions involving paper documents. Maine Notaries like those in Florida and South Carolina, can officiate at wedding ceremonies. Once commissioned as a Notary Public, it is the responsibility of the Notary Public to maintain a level of education appropriate for conducting notarial duties. The Secretary of State encourages Notaries to attend workshops on a yearly basis to remain current and avoid conducting inappropriate or flawed notarizations. Today, Maine and New Hampshire** adult residents can become and function as Maine Notaries Public.

** Only NH residents who are regularly employed or carry on a trade or business in Maine can be commissioned as a Notary Public in Maine

Renewal of Notary Public Commission

To renew your commission, please use our Total Notary Solution - Online Renewal. This service allows you to update your Notary Public Commission information with the Secretary of State, as well as to renew your Commission.You may update your last name, legal, physical and/or mailing addresses, contact telephone numbers, email address and any other language fluency.

Because of a law change in September 2007, when renewing your Commission, you must now take an online Notary Public Law and Practices Knowledge Examination. The examination includes 30 questions covering a variety of areas relating to Maine notarial laws and practices. While taking the examination, if you provide an incorrect response, you will have the opportunity to review the related information from the online handbook and adjust your response accordingly. You will not be able to move to the next question until a correct response is provided.

After completing the examination portion of the renewal process, you will be required to print documentation relating to your renewal.This documentation includes the application for renewal (your examination questions and responses and residency verification), notice providing information about your new commission and your Oath of Office form.As you did when you initially applied for Notary Public Commission, you will need to appear before a Notary Public to have your renewal application notarized and have your municipal clerk or registrar of voters verify your residency in Maine. You must also appear before a Dedimus Justice to take your oath of office.Once you have had your renewal application notarized, your residency verified and you have taken your oath, this material must be returned to the Secretary of State to complete the renewal process.

You may renew your Commission if:

  • Your Commission will expire within the next 45 days; or
  • Your Commission has expired within the last 20 days (You will maintain your current month & day for your new expiration date year); or
  • Your Commission has expired within the last 21 to 90 days (you will be given a new month & day for your new expiration date year)
