WEEKLY NOTICES OF STATE RULEMAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." CHAPTER NUMBER AND TITLE: Ch. 3, Maine Clean Election Act and Related Provisions
TYPE OF RULE: Major Substantive
PROPOSED RULE NUMBER: 2020-P220 (2nd publication, with chapter and title correction)
BRIEF SUMMARY: A candidate who had received traditional campaign contributions that did not comply with seed money restrictions who decided to run for a different office would have a limited opportunity to participate in the Maine Clean Election Act program for the second office.

Ch. 268, Pine Shoot Beetle Quarantine (Repeal)
Ch. 271, Gypsy Moth Quarantine (Repeal)
TYPE OF RULES: Routine Technical
PROPOSED RULE NUMBERS: 2020-P232, P233
BRIEF SUMMARY (ch. 268): This proposal will remove the state quarantine requirements that restrict the movement of wood that may be infested with the pine shoot beetle (PSB). PSB is now considered established in Maine and is not seen as a continued threat to Maine’s forests. This proposed rule repeals the entire ch. 268, Pine Shoot Beetle Quarantine.
BRIEF SUMMARY (ch. 271): This proposal will remove the state quarantine requirements that restrict the movement of plants, wood or other articles that may be infested with European Gypsy Moth. A full state federal quarantine will remain in place. This proposed rule repeals the entire ch. 271, Gypsy Moth Quarantine.

ADOPTIONS


AGENCY: 09-137 – Department of Inland Fisheries and Wildlife (IFW)
CHAPTER NUMBER AND TITLE: Ch. 6, Educational and Scientific Collection Permit Rules
ADOPTED RULE NUMBER: 2020-243
CONCISE SUMMARY: The Department of Inland Fisheries and Wildlife has amended ch. 6 rules, which will change the reference of permitting for educational and scientific collection of “wild animals and wild birds” to “wildlife” as it is currently referenced in statute. This will create consistency between law and rule and update the terminology used to describe species covered under the permit. A copy of the rule can be requested from the agency contact person.
