WEEKLY NOTICES OF STATE RULEMAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." PROPOSED RULE NUMBER: 2019-P042 (2nd publication)
CONCISE SUMMARY: Per LD 1166, SP 387, An Act Regarding Anesthesia Care in Maine, effective September 12, 2017, the proposed rule addresses the elimination of the certified registered nurse anesthetist’s requirement to be accountable to a licensed physician or dentist in rural and critical access hospitals. The proposed rule adds prescriptive authority to the CRNA’s scope of practice in the preoperative and immediate postoperative period. The rule clarifies the treatment and prescribing of medications to family and friends, allows for the initial licensure of advanced practice nurses that may have a degree that is more than a master’s degree, reduces the continuing education requirement, and clarifies the twenty-four-month supervisory requirement.

BRIEF SUMMARY: In accordance with 12 MRS §2701 sub-§5, the Commissioner may adopt rules regulating public use of Department owned or maintained boat launch facility sites. The proposed rule will provide the Department and public clear guidance on how water access facilities can be utilized. Types of use such as swimming, parking, discharging of waste, fires and camping are clarified to provide the Department and law enforcement the ability to ensure public safety. Rules unique to the specific state-owned boat launch facility site at Mere Point in Brunswick will be limited to boats with a length of 24 feet or less and provide regulations for overnight parking at the site. CONCISE SUMMARY: The Public Utilities Commission repeals Ch. 32 of the Commission's Rules (65-407 CMR ch. 32), which sets forth rules establishing service standards for electric transmission and distribution utilities. Ch. 32 has been replaced by Ch. 320, which was adopted by the Commission on June 7, 2019.

CHAPTER NUMBER AND TITLE: Ch. 1, Open Water and Ice Fishing Regulations (North Zone General Law)
ADOPTED RULE NUMBER: 2019-155
CONCISE SUMMARY: The Department of Inland Fisheries and Wildlife has amended the General Law for fishing regulations in the North Region (Franklin, Somerset, Piscataquis, Aroostook, and northern portions of Oxford and Penobscot Counties) to further protect wild trout waters, including tributaries and outlets of heritage ponds in the North Region. The rule will prohibit use and possession of live fish as bait, except where designated by special rule (S-11 ), reducing the chance of new introductions of baitfish and other fish in the vast majority of flowing waters, dead-waters and small ponds in the North Region. The majority of waters with traditional use of live fish as bait will continue to allow such use under this proposal by addition of the special code. A new section in General Law titled "Terminal Gear" has also been added. The list of affected waters and amended General Law may be obtained from the Agency Contact Person below. The new rules will become effective January I, 2020 and will be published in the 2020 Maine Open Water and Ice Fishing regulations booklet and posted on the Department's website at: http://www.maine.gov/ifw/fishingboating/fishing/laws-rules/index.html .

CHAPTER NUMBER AND TITLE: Ch. 1, Open Water and Ice Fishing Regulations (Conroy Lake Petition)

CONCISE SUMMARY: The Department of Inland Fisheries and Wildlife has adopted the following change to fishing regulations for CONROY LAKE, Monticello (North Region). General fishing laws apply, except: B, CI. S-8, S-19. Open to open water fishing from October 1 - November 30: ALO, S-7. The rule is the result of a valid public petition to consider opening Conroy Lake to ice fishing. Beginning January I, 2020, Conroy Lake will be open to ice fishing under the B season code, January 1 - March 31.
