Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." PROPOSALS

AGENCY: 05-071 – Department of Education (DOE)
CHAPTER NUMBER AND TITLE: Ch. 115, The Credentialing of Educational Personnel
PROPOSED RULE NUMBER: 2018-P286
BRIEF SUMMARY: The proposed rule includes revisions to rule Ch. 115, Part I and Part II. The Part I revisions are to the current rule Ch. 115 Part I, adopted in July 2018. The Part II revisions are to rule Ch. 115 Part II, adopted in August, 2017, and scheduled to take effect on July 1, 2019.
Part I revisions further refine and correct for articulation with statute and Part II and clarify certain provisions.
Part II revisions include clarifications and refinements as well as more substantial changes, including the elimination of some provisions scheduled to take effect July l, 2019. Highlights of Part II proposed changes:
1. Eliminates literacy course work for Secondary Teacher Endorsement, Pathway 2;
2. Reverts to and refines current endorsement area grade spans: Public preschool-3, K-8, 6-12, Public preschool-12, and K-12;
3. Establishes a pathway to qualifying as a secondary teacher based on work experience and specified education course work;
4. Provides for Career and Technical Education endorsement content to be satisfied through degree programs contingent upon comparability;
5. Sunsets in 2020 Endorsement 093: School Psychologist (Specialist or Doctoral), Pathway 4; meanwhile updating the requirements for this pathway;
6. Repeals and replaces endorsement pathways for some certificates to account for statutory changes in types of certificates (e.g., the elimination of the targeted certificate) and for clarity.

ADOPTIONS

AGENCY: 65-407 – Maine Public Utilities Commission (MPUC)
CHAPTER NUMBER AND TITLE: Ch. 288, Maine Universal Service Fund
ADOPTED RULE NUMBER: 2018-272
CONCISE SUMMARY: The Commission amends the rule to make it compatible with the provisions of the current telecommunications regulation statutes, and because the changes will provide stability to the amounts contributed to the Fund and will integrate the collection of the MUSF with that of the Maine Telecommunications Education Access Fund (MTEAF), which itself was amended in Docket No. 2017-00283 to adopt a new contribution methodology, as required by statute.
ADOPTION EFFECTIVE DATE: December 24, 2018. “The Commission intends to implement the changes to the Rule by July 1, 2019.”
