Public Input for Proposed and Adopted Rules
Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. BRIEF SUMMARY: The Department is proposing to amend Ch. 310 to limit the definition of certain Wetlands of Special Significance to include contiguous wetlands within a 250-foot radius unless the Department determines that the activity may unreasonably adversely affect the protected resource that created the WOSS designation. The proposed rulemaking would also add shoreline stabilization projects to the list of projects that may be considered in a WOSS subject to an alternatives analysis and clarifies the definitions of “Emergent Marsh Vegetation” and “Peatland”.

CHAPTER NUMBER AND TITLE: Ch. 415, Reasonable Costs for Handling, Transportation, and Recycling of Electronic Wastes
PROPOSED RULE NUMBER: 2018-P109
BRIEF SUMMARY: The proposed changes to Ch. 415 are in response to changes in statute resulting from the enactment of LD 1847 as PL 2018 ch. 391. The proposed changes include the addition of 3D printers as covered devices; changes to the method for calculating payment for the recycling of monitors and printers so that the cost of recycling is paid according to market share and no longer brand-sorted, with the result that historic manufacturers will no longer be billed for recycling; and moving the due date for annual manufacturer registrations to April 1. Other changes include incidental corrections to punctuation and grammar. No significant changes to Department operations relating to the program are anticipated.

CHAPTER NUMBER AND TITLE: Ch. 166 (New), Industrial Cleaning Solvents
PROPOSED RULE NUMBER: 2018-P110
BRIEF SUMMARY: Section 184 of the Clean Air Act requires states to implement or update reasonably available control technology “RACT” controls on all major VOC and NOx emission sources and on source categories covered by a Control Technique Guideline “CTG” document. EPA defines RACT as the lowest emission limit that a particular source is capable of meeting by the application of control technology that is reasonably available considering technological and economic feasibility. In 2006 EPA published a CTG recommending VOC controls for industrial cleaning solvents; the Department is proposing to incorporate this CTG into a new rule, which will be submitted to the U.S. Environmental Protection Agency for approval in Maine's State Implementation Plan.
The Department’s proposal expands the types of VOC emissions controlled to include those from industrial cleaning solvents in a new rule, Ch. 166. The emission limits are achieved by using low-VOC solvents and work practices.

BRIEF SUMMARY: The current Ch. 33, Home Modification Tax Credit Rule, is being repealed and replaced with a new AccessAble Home Tax Credit Rule. The replacement rule: (1) changes the name to AccessAble Home Tax Credit Rule; (2) corrects the statutory reference in paragraph 1.d. and paragraph 5; and (3) provides that the credit will be taken in the year MaineHousing issues a certificate rather than in the year the modification expenses are incurred. BRIEF SUMMARY: The proposed rule contains updates to Maine’s newborn bloodspot screening (NBS) requirements, including (1) screening for additional conditions in conformity to recommendations by the U.S. DHHS; (2) protocols for collecting and storing NBS specimens; (3) reporting out-of-range-test results; and (4) releasing NBS samples for research purposes. The proposed rule includes additional terms and definitions, along with a revised construction of the rule format, for improved readability. Proposed changes are in conformity to the U.S. DHHS recommendations for newborn screening, supported by the U.S. Health Resources and Services Administration (HRSA) for infants and children under the Public Health Service Act.

BRIEF SUMMARY: The Maine Land Use Planning Commission is seeking public comment on proposed amendments to Ch. 10, Land Use Districts and Standards, related to the Commission’s policy for locating new development – called the adjacency principle. Today, single family homes can locate in most places in the Commission’s service area, but new zones for subdivisions and commercial development are generally needed and generally must be located within one mile by road of existing compatible development. The proposed changes would replace the one mile rule-of-thumb with a new system for locating most new development near existing communities and public roads. The proposal also would allow commercial and residential development that is dependent on, or centered around, natural or recreational resources to locate near these resources in certain circumstances. The Commission anticipates that the proposed rule changes will be revised in response to public comments. A revised draft of the proposed rule changes will be published on the Commission’s website by August 29, 2018. Paper copies will be available by request.

BRIEF SUMMARY: The amendments to Ch. 220 provide that a continuing education credit of up to 7 hours may be granted once during a continuing education cycle for participation, other than as a student, in appraisal education processes and programs. These amendments are proposed in response to a Federal audit conducted last spring.
The amendments to Ch. 240 update the Standards with which licensees must comply. Effective January 1, 2018 licensees will be expected to comply with the 2018-2019 edition of the Uniform Standards of Professional Appraisal Practice (“USPAP”). Title 32 MRS §14012(3) authorizes the board to establish standards of practice for licensed real estate appraisers, and 32 MRS §14028 requires licensees to comply with the Uniform Standards of Professional Appraisal Practice (“USPAP”), as promulgated by the Appraisal Standards Board of the Appraisal Foundation. This amendment designates the 2018-19 edition of USPAP as the standards of practice in effect beginning January 1, 2018. Changes from the 2016-17 edition are discussed in detail in the Appraisal Standards Board’s “2017 Summary of Actions Related to USPAP Changes” (February 23, 2017). CONCISE SUMMARY: The Commissioner adopts this emergency rulemaking to implement the closure of the 2018 elver season, effective at 6 a.m., May 24. The holder of an elver fishing license may not fish for or take elvers after 6 a.m. on May 24, but may possess and sell elvers until noon on May 24. The Department is aware of significant illegal sales of elvers for cash that were not recorded through the swipe card system as required. The Department believes that if these sales had been recorded, the 2018 elver quota would have already been reached or exceeded. For this reason, an immediate closure of the fishery is necessary to prevent unusual damage and imminent depletion of the elver resource, caused by exceeding the 2018 elver fishing quota. The Commissioner hereby adopts an emergency closure of Maine's elver fishery as authorized by 12 MRS §6171(3)(A}.

CONCISE SUMMARY: 10-149 CMR ch. 1 (the “APS Rule”) is an entirely new rule and it consolidates the two systems for conducting APS investigations and provides clarification to ensure a uniform Adult Protective Services system for all incapacitated and dependent adults. The APS rule addresses Adult Protective Services reporting requirements, the Central Intake (referral) process, the investigation process, Adult Protective Services casework functions, investigation findings requirements, and substantiations of abuse, neglect, or exploitation of persons with IDD/A who are recipients of Department services. The APS rule replaces Sections 11, 12, and 14 in 10-149 CMR ch. 5, and Sections 6.04 and 6.05 in 14-197 CMR ch. 12. 10-149 CMR ch. 5 is amended by deleting Sections 11, 12, and 14, which are not replaced as a part of this rulemaking.

CONCISE SUMMARY: In this rule adoption, the Department repeals 14-197 CMR ch. 12 (Regulations Governing Reportable Events, Adult Protective Investigations and Substantiation Hearings Regarding Persons with Mental Retardation or Autism), and replaces it with the adopted 14-197 CMR ch. 12 (Reportable Events System) (the “Reportable Events Rule”). The Department is adopting this rule to outline requirements for providers in reporting and responding to Reportable Events affecting the safety or welfare of adults with intellectual or developmental disabilities or Autism Spectrum Disorder (“IDD/A”) or Acquired Brain Injury (“ABI”) who have been determined to be eligible for and who are receiving services from a provider of services licensed, funded, or regulated in whole or in part by the Department (“Individuals Receiving Services”).

CHAPTER NUMBER AND TITLE: Ch. 4, Hunting and Trapping: 4.05, Moose Hunting Season

CONCISE SUMMARY: The Department of Inland Fisheries and Wildlife has allocated the number of moose hunting permits to be issued for the 2018 moose hunting season. Permits will be issued for bulls, antlerless and any-moose. The Department has also opened WMDs 10, 18, 27 and 28 to the September season. Bull only permits allocated will be split evenly between the September and October season in those WMDs. The Department has also amended the rule to allow those selected in WMDs 27 or 28 to hunt in either WMD during the designated open season. Permit allocations according to Wildlife Management District are as follows:

CHAPTER NUMBER AND TITLE: Ch. 11, Scallops; 11.14, Atlantic Sea Scallop Limited Entry Program
ADOPTED RULE NUMBER: 2018-089 (Final adoption, major substantive)
CONCISE SUMMARY: This regulation establishes two annual lotteries (one for drag licenses, one for dive licenses) for the issuance of new scallop licenses. The number of new licenses available is calculated by applying an exit ratio to the number of licenses retired by each gear sector in the previous calendar year. The regulation also establishes the eligibility criteria to enter the lottery and factors that would give an individual additional chances in the lottery.
