WEEKLY NOTICES OF STATE RULEMAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." BRIEF SUMMARY: Pursuant to 35-A MRS Sections 7104-B(2-A) and 7104-C, and Section 2 of PL 2017 ch. 244 "An Act to Ensure Continued Availability of High-speed Broadband Internet at Maine's Schools and Libraries," the Maine Public Utilities Commission initiates a rulemaking to amend Ch. 284, Prepaid Wireless Fee, to conform Ch. 284 to current Maine law.

CHAPTER NUMBER AND TITLE: Ch. 280, Maine Birth Defects Program Rule
ADOPTED RULE NUMBER: 2017-194
CONCISE SUMMARY: This rule establishes the responsibilities of hospital administrators, physicians and other health care providers, including licensed midwives, for reporting birth defects in infants and fetuses; provides the confidentiality requirements of the Maine Birth Defects Program; describes the nature of contact between the Maine Birth Defects Program and families of children with birth defects; and describes parental objection to birth defect reporting or participation in the birth defect registry. This amendment updates the reportable birth defects listing and clarifies wording for referral to the Part C Agency (Child Development Services) in Maine. Changes include minor technical changes and reformatting.

CHAPTER NUMBER AND TITLE: Ch. 6, Educational and Scientific Collection Permit Rules: 6.01, Scope of Rules; 6.02, Permit Required
ADOPTED RULE NUMBER: 2017-195
CONCISE SUMMARY: The Department of Inland Fisheries and Wildlife had adopted changes to Ch. 6 rules to reflect amendments made to 12 MRS ?12152 and the repeal of ?12704 during the 1st session of the 127th Legislature. Statutory reference within the rule has been updated, and the term ?wild animals and wild birds? has been amended to ?wildlife? to correlate with the statute. Use of the term ?wildlife? includes reptiles, amphibians and some invertebrates in addition to wild animals and wild birds for use in educational or scientific purposes.
