WEEKLY NOTICES OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules
Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." BRIEF SUMMARY: The Department of Inland Fisheries and Wildlife has been petitioned to amend the Expanded Archery Deer Hunting Season areas by updating road names and routes within a portion of Wildlife Management District 24 to remove the Town of Phippsburg from the expanded archery hunting area. BRIEF SUMMARY: The Department proposes updates to the Rules for the Control of Notifiable Diseases and Conditions to better align with new and emerging diseases and more efficient methods of reporting being adopted nationally. The Department is proposing updates to the notifiable diseases and conditions list to better reflect diseases that are most important to prevent and control to protect public health in Maine.
DETAILED BASIS STATEMENT / SUMMARY: The Department proposes updates to the Rules for the Control of Notifiable Diseases and Conditions to better align with new and emerging diseases and more efficient methods of reporting being adopted nationally. The Department is proposing updates to the notifiable diseases and conditions list to better reflect diseases that are most important to prevent and control to protect public health in Maine.
Specifically the state proposes the following changes:

6. Update the wording for Health Care Facility and Infection Control Preventionist (pg. 3, 4)
7. Update the definition for non-compliant person (pg. 4)
8. Update the wording for notifiable condition (pg. 4)
9. Remove sexually transmitted infection definition (pg. 5)
10. Update the fields required in disease reports (pg. 7-8)

BRIEF SUMMARY: The Department is proposing a new rule establishing minimum inspection, preparedness, and reporting requirements for operators of rail tank cars transporting or storing oil in Maine. The rule establishes requirements for the remediation of any oil discharges from rail tank cars, requires the submission of federal Response Plans to the Department, and establishes inspection requirements for rail cars that are used for storage, and parked at a siding for more than 5 consecutive days.

Rule 5.5: This change is necessary to increase recreational opportunities for Baxter State Park visitors without increasing impacts on the natural resources.

CHAPTER NUMBER AND TITLE: Ch. 696, Oil Discharge And Pollution Control Rules For Rail Tank Cars
ADOPTED RULE NUMBER: 2015-053 (Emergency/New)
CONCISE SUMMARY: The Commissioner adopts this emergency rule to establish minimum inspection, preparedness, and reporting requirements for operators of rail tank cars transporting or storing oil in Maine. The rule establishes requirements for the remediation of any oil discharges from rail tank cars, requires the submission of federal Response Plans to the Department, and establishes inspection requirements for rail cars that are used for storage, and parked at a siding for more than 5 consecutive days. In recent years, there has been a significant growth in the number of rail tank cars used to transport oil in Maine, with a concomitant increase in the use of these tank cars for longer-term storage of oil at rail sidings adjacent to rivers and residential areas. The Department is concerned that these practices pose a considerable risk to our sensitive natural resources, including Class AA and Class A surface waters, and to groundwater serving public and private drinking water supplies. This emergency rule will provide the Department with accurate and timely information in the event of an oil discharge or other emergency event, and significantly reduce the likelihood of a release of oil that would create a local safety, public health, or environmental hazard.
