WEEKLY NOTICES OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. BRIEF SUMMARY: The Department’s proposal repeals the Stage II requirement January 1, 2012, and requires the removal and/or discontinuance of Stage II vapor controls no later than January 1, 2013. The proposal includes procedures to ensure all piping is properly capped and tested for vapor tightness. The repeal of the Stage II requirement requires the implementation of new emission controls that provide equivalent (or greater) volatile organic compounds (VOC) emission reductions to make up for those VOC reductions lost with the elimination of Stage II (removal of the Stage II controls will result in an additional 0.245 tons per summer weekday (tpswd) of VOC emissions). The Department is proposing the installation and testing of pressure/vacuum vent caps on gasoline dispensing facilities with a throughput of 10,000 to 100,000 gallons per month by January 1, 2012 as one of the measures used to address this requirement, with this measure providing approximately 0.1 tpswd reduction in VOCs. The Department will be providing additional measures to address the remaining shortfall. BRIEF SUMMARY: The Clean Air Act requires states to implement or update their regulations to require control technology on certain sources of volatile organic compound (VOC) emissions which contribute to the formation of ground-level ozone. This proposal expands the types of paneling regulated by Ch. 129 to include exterior siding and tileboard. The amendments lower the threshold above which sources are subject to the rule to 15 lbs/day of VOC (from 10 tons per year). VOC emission limits for metal furniture and flatwood paneling coating operations are more stringent, in some cases, than current limits. BRIEF SUMMARY: The Department is proposing amendments to Section 16 Activities in coastal sand dunes that are major substantive rules. Proposed amendments include allowing several new activities in coastal sand dunes, such as open and cobble-trapping fences, and other activities in existing developed areas. Also proposed is the addition of new submission requirements and standards to ensure projects are properly performed. In addition, definitions have been added, deleted or modified to align with the definitions in the Coastal Sand Dune Rules, 06-096 CMR 355, which was amended in 2006.
These rule changes were approved by the Legislature in Resolve Chapter 167, effective on May 21, 2010. However, the Department failed to obtain final approval from the Board of Environmental Protection within 60 days as required by the Administrative Procedure Act. Therefore, these rules need to go through the rule-making process again.

CONCISE SUMMARY: The Commissioner of Inland Fisheries and Wildlife has adopted rules establishing beaver trapping season dates and individual township openings and closings for the beaver trapping as well as modifications to trap types and set-back requirements for beaver trapping in specific Wildlife Management Districts. Townships or portions thereof are opened and closed on an individual basis to manage local beaver populations within the general season framework.

The Revenue/HCPC combinations to be included are 0651/T2042 Routine Home Care (per diem), 0652/T2043 Continuous Home Care (hourly), 0655/T2044 Inpatient Respite Care (per diem), 0656/T2045 General Inpatient Care (per diem), 0657/appropriate CPT code per Section 90, Physician Services. In addition, the emergency rule permits terminally ill MaineCare members under the age of 21 to receive hospice services without requiring them to forgo other treatments covered by MaineCare. This implements Section 2302 of the Affordable Care Act (Pub. L. No. 111-148 as amended by the Health Care and Education Reconciliation Act of 2010 (Pub. L. No. 111-152).

CONCISE SUMMARY: The purpose is to incorporate by reference regulations governing occupational safety and health in construction employment as promulgated by the Federal Occupational Safety and Health Administration regarding the protection of workers performing construction activities within the roadway and to be consistent with the National Manual for Uniform Traffic Control Devices Standards.
