WEEKLY NOTICES OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." PROPOSED RULE NUMBER: 2010-P164
CONCISE SUMMARY: Ch. 6 establishes minimum standards for the design, installation, operation, and maintenance of extinguishing systems aimed primarily at minimizing fire loss in commercial facilities. As currently written, Ch. 6 incorporates by reference several National Fire Protection (NFPA) standards, including NFPA #17, Standard for Dry Cleaning Chemical Extinguishing Systems, 2002 edition, and NFPA #17A, Standard for Wet Chemical Extinguishing Systems, 2002 edition. This rule proposes to incorporate by reference the 2009 edition for NFPA standards #17 and #17A, to replace the 2002 editions.

CONCISE SUMMARY: Ch. 13 sets forth safety requirements for individuals involved in welding, cutting and allied processes and for acetylene cylinder charging plants. As currently written, Ch. 13 incorporates by reference several National Fire Protection Association (NFPA) standards including NFPA #51B, Standard for Fire Prevention During Welding, Cutting, and Other Hot Work, 2003 edition. This rule proposes to incorporate by reference the 2009 edition of NFPA standard #51B, to replace the 2003 edition.

CONCISE SUMMARY: Ch. 14 is a safety code that applies to the installation of fuel gas piping systems, appliances, equipment, and related accessories. As currently written, Ch. 14 incorporates by reference National Fire Protection Association (NFPA) Code # 54, National Fuel Gas Code, 2006 edition. This rule proposes to incorporate by reference the 2009 edition of NFPA Code # 54, to replace the 2006 edition.

CONCISE SUMMARY: Ch. 18 is a new rule. It will outline requirements for approved carbon monoxide detectors, and their use, maintenance and installation. This rule will incorporate by reference Ch. 9, Single- and Multiple-Station Alarms and Household Carbon Monoxide Detection Systems of the National Fire Protection Association (NFPA) Standard # 720, Standard for the Installation Carbon Monoxide (CO) Detection and Warning Equipment, 2009 edition.

CONCISE SUMMARY: Ch. 19 as currently, written incorporates National Fire Protection Association (NFPA) Standard #96, Standard for the Ventilation Control and Fire Protection of Commercial Cooking Operations, 2008 edition. This amendment provides that public and private commercial residential and daycare center occupancies are not required to meet the hood and duct system requirements specified in NFPA Standard #96, Standard for the Ventilation Control and Fire Protection of Commercial Cooking Operations, 2008 edition.

RULE TITLE OR SUBJECT: Ch. 20, Code for Safety to Life from Fire in Buildings and Structures
PROPOSED RULE NUMBER: 2010-P169
CONCISE SUMMARY: Ch. 20 addresses the construction, protection, and occupancy features necessary to minimize danger to life from the effects of fire, including smoke, heat, and toxic gases. This rule incorporates by reference several National Fire Protection Association (NFPA) codes and standards, including NFPA #220, Standard on Types of Building Construction, 2006 edition. This amendment will incorporate the 2009 edition of NFPA #220, to replace the 2006 edition, and clarify the language of the chapter without making other substantive changes.

RULE TITLE OR SUBJECT: Ch. 28, Rules Governing Operations of Amusement Devices and Midways

CONCISE SUMMARY: Ch. 28 provides standards for the safe operation of amusement park rides, devices, and midways. This amendment reformats the rule and deletes outdated license application and accident reporting forms from the rule. These forms will no longer be part of the rule, and are made available to the public and regulated community on the Department of Public Safety, Fire Marshal’s website.

RULE TITLE OR SUBJECT: Ch. 101, MaineCare Benefits Manual: Ch. III Section 21, Home and Community Benefits for Adults with Mental Retardation or Autistic Disorder
PROPOSED RULE NUMBER: 2010-P173
CONCISE SUMMARY: The Department proposes changes to Ch. III, Section 21, Home and Community Benefits for Adults with Mental Retardation or Autistic Disorder. Specifically, this proposed rule reduces the reimbursement rates by 2% for day habilitation and work support services and reduces rates for services delivered in a residential setting by 1%; all other services are reduced by 10%. In addition, the Department proposes modifications to certain codes in order to make policy align with the new claims system structure. In addition, a modified rate for use in calculating the Agency Home Supports per diem is established for hours in excess of 168 per week. This proposed rule also changes the title of this chapter to Allowances for Home and Community Benefits for Members with Intellectual Disabilities or Autistic Disorder. This proposed rule-making is necessary in order to begin permanent adoption of the emergency rule in effect as of July 1, 2010. These are major substantive rules that must be approved by the legislature before they are finally adopted. These amendments were previously adopted as an emergency rule on July 1, 2010.

TITLE OR SUBJECT: Ch. 101, MaineCare Benefits Manual: Ch. II & III Section 28, Rehabilitative and Community Support Services for Children with Cognitive Impairments and Functional Limitations
PROPOSED RULE NUMBER: 2010-P174
CONCISE SUMMARY: The proposed rule permanently adopts new rates that were adopted via emergency rule effective 7/1/10.
Ch. II: The Department added a new category of children who are eligible for Section 28 services: those children between the ages of birth and five years who have been diagnosed with a specific congenital or acquired condition, with a written assessment by a physician that they will meet the functional impairment criteria if services and supports are not provided to these children. Additionally, schools, as defined in the regulation, have been added as a new provider of Section 28 services.
Ch. III: The proposed rule will permanently adopt a 2% rate reduction for all covered services. P.L. 2009, ch. 571 PART A, Sec. A-25 required the Department to reduce funding based on a 10% reduction to the rates paid to providers under Section 28. However, P.L. 2009, ch. 571 PART RRRR, Sec. RRRR-1 authorized the Department to use funds provided in this Part to adjust MaineCare rates, otherwise subject to a 10% reduction, to actuarially based rates, as deemed necessary and applicable by the Department. The Department determined that it is necessary and applicable to use the additional funding so that the Section 28 rates were reduced by 2%, not 10%. The proposed rule also adds new group ratios for 2:1 (two members to one staff) and 3:1 (three members to one staff) service delivery.
The proposed rule provides that during a start up period of July 1, 2010 through October 31, 2010, prior authorization is not required for any Section 28 services.
There is no expected impact on small businesses, municipalities or counties, other than providers of this service. This rule will benefit providers by increasing eligibility but does include a rate reduction.

These changes were adopted as an Emergency Rule on July 1, 2010. Specifically, this rule proposes a reduction in reimbursement rates by 2% for day habilitation and work support services; all other services are reduced by 10%. These proposed rules comply with State statute regarding budget initiatives designed to balance the State budget. In addition, the Department is adopting minor changes in the billing codes to be employed with the adoption of the Maine Integrated Health Management system, anticipated to occur in August.

CONCISE SUMMARY: This chapter establishes the procedures governing the selection of service providers for conservation programs and the selection of projects to receive awards under grants administered by the Efficiency Maine Trust. Most service providers and grant recipients will be selected by means of a competitive bid process conducted by issuing Requests for Proposals or similar documents. Some service providers may be selected without a competitive bid process, when sole-source contracting is the most efficient means to deliver conservation programs. The chapter also establishes the procedure to seek reconsideration of a selection decision.

CONCISE SUMMARY: The purpose of this rule is to set forth the procedures used by the Department of Secretary of State for receiving applications and granting permits for the movement of oversized and/or overweight combination vehicles engaged in interstate travel on highways and bridges under the jurisdiction of the Department of Transportation pursuant to the Interstate Compact adopted by the New England Transportation Consortium.

CONCISE SUMMARY: 1. The purpose of this rule is to set forth the procedures used by the Department of Secretary of State for the regulation of the Canadian Weight Limits (CWL) Program. The purpose of this program is to allow motor carriers with specific vehicle configurations to cross at certain United States-Canada borders, over pre-determined routes, to specified destinations within Maine.

CHAPTER NUMBER AND TITLE: Ch. 1, Supplemental Education Loan Program Rules
ADOPTED RULE NUMBER: 2010-284
CONCISE SUMMARY: This rule-making amends the Supplemental Education Loan Program Rules to make revisions to the eligible schools, finance charges, repayment terms, and forbearance sections for the Authority’s loan programs. The rule amendment will: clarify the definition of eligible schools; provide increased flexibility to allow for future fixed interest rate loan programs; remove the loan repayment term tables to enable the Authority to modify repayment terms for loans funded from the proceeds of future bond issuances to match the repayment schedule for the bonds; and allow for an extended period of forbearance in certain extenuating circumstances.

CHAPTER NUMBER AND TITLE: Ch. 4.08, Falconry
ADOPTED RULE NUMBER: 2010-285
CONCISE SUMMARY: The Department of Inland Fisheries & Wildlife has adopted a rule replacing the entire chapter for falconry regulations, in order to bring Maine regulation into compliance with Federal regulations. The revision eliminates the need for a falconer to hold a Federal falconry permit upon adoption of these revisions. This amendment brings Maine's falconry regulations into compliance with the revised federal regulations. A copy of the new regulations may be obtained from the Agency Contact Person listed below.
