Glossary of Fantasy Gaming Terms

Auto draft

“Auto Draft” means athlete selection offered by a fantasy contest operator that does not involve any input or control by a fantasy contestant.

Beginner fantasy contestant

"Beginner fantasy contestant" means an individual who has entered fewer than 51 fantasy contests offered by a single fantasy contest operator.

Clearly and conspicuously

A.    To disclose in such a way that the disclosure is made through the same means through which the communication is presented;

B.    Requires that if the communication is visual, the disclosure is placed in close proximity to relevant claims, expressed in clear and plain language and syntax, and the size, contrast, location, and other characteristics stand out from other visual elements so that the disclosure is prominently displayed and unavoidable;

C.    Requires that the disclosure is repeated if necessary and is visible for a sufficient duration;

D.    Requires that if the communication is audio, the disclosure is presented at adequate volume and cadence;

E.    Requires that the disclosure is made before the fantasy contestant decides to accept an offer.

Commissioner

“Commissioner” means the Commissioner of Public Safety.

Daily fantasy contest

“Daily fantasy contest” is any fantasy contest other than a season-long fantasy contest, as defined herein.

Director

"Director" means the director of the Gambling Control Unit within the Department of Public Safety.

Entry fee

"Entry fee" means cash or a cash equivalent that is required to be paid by a fantasy contestant to a fantasy contest operator in order to participate in a fantasy contest.

Fantasy contest

"Fantasy contest" means a simulated game or contest in which:

A.   One or more fantasy contestants pay an entry fee to participate.

B.   Fantasy contestants compete against each other by using their knowledge and understanding of sports events and persons engaged in those sports events to select and manage a simulated team roster whose performance directly corresponds with the actual performance of human competitors on sports teams and in sports events; and;

C.   The outcome of the game or contest reflects the relative knowledge and skill of the contestants and does not depend on the performance of any one participant in a sports event or the outcome of any one sports event but is determined predominantly by accumulated statistical results of the performance of individual competitors on sports teams and in sports events.

Fantasy contestant

"Fantasy contestant" means an individual who participates in a fantasy contest offered by a fantasy contest operator.

Fantasy contest operator

"Fantasy contest operator" means a person that offers a platform for the playing of fantasy contests and that administers a fantasy contest for which a prize of value is awarded.

Geolocation

“Geolocation” is the process of identifying a device's physical location using methods like GPS, cellular network signals, Wi-Fi, or IP address tracking.

Geolocation service provider

“Geolocation service provider” is an organization, company or corporation that provides a technology-based system that determines the geographic location of a device. Geolocation services use a variety of data sources, including GPS, cell towers, Wi-Fi, and IP addresses.

Global Positioning System (GPS)

is a satellite-based navigation system that provides information about a device's location, velocity, and time. This data is used and verified each time the fantasy contestant seeks access from a mobile device or network when entering a fantasy contest or depositing funds.

Gross fantasy contest revenues

"Gross fantasy contest revenues" means the amount determined by subtracting the total of all sums paid out by a fantasy contest operator as cash prizes to all fantasy contestants from the total of all entry fees that the fantasy contest operator collects from all fantasy contestants and multiplying the result by the resident percentage. Sums paid out as prizes may not include the cash equivalent of any merchandise or something of value awarded as a prize.

Highly experienced fantasy contestant

"Highly experienced fantasy contestant" means a fantasy contestant who has,

A.  Entered more than 1,000 fantasy contests operated by a single fantasy contest operator; or

B.  Won more than 3 prizes of $1,000 or more each from a single fantasy contest operator.

Minimum Internal Controls

“Minimum Internal Controls” are a set of guidelines, rules, policies and or procedures whose primary purpose is to help safeguard an organization and further its objectives. Internal controls function to minimize risks and protect assets, ensure accuracy of records, promote operational efficiency, and encourage adherence to policies, rules, regulations, and laws.

Minor

“Minor” means any person who has not attained 18 years of age.

Platform

"Platform" means an online or electronic method by which access to a fantasy contest is provided, including, but not limited to, a website, personal digital device, such as a device commonly known as a smartphone, or other application providing access to a fantasy contest.

 

Private contest

“Private contest" means a fantasy contest established among contestants known to each other and the terms and any prize of which are not established by a fantasy contest operator.

Prize

“Prize” means an award, incentive, promotion, or anything of value, including, but not limited to, money, contest credits, merchandise or admission to another fantasy contest.

Proposition bet

"Proposition bet" (prop bet, prop, novelty, or a side bet) is a bet made regarding the occurrence or non-occurrence during a game (usually a gambling game) of an event not directly affecting the game's outcome. Traditionally, proposition bets can be made on outcomes such as the number of strikeouts a pitcher will accumulate in a baseball game, whether a non-offensive player will score in an American football game, which team will score the first points of the game, the discipline record of teams in a match, the timing of certain events, the number of specific events per team or in the entire match, realistically any statistically discrete event contained in a match or game could be bet on.

Proxy server

“Proxy server” is a server application that acts as an intermediary between a client requesting a resource and the server providing that resource. It improves privacy, security, and possibly performance in the process. Proxy servers can be used to filter out geolocation information or the origin of the source that is requesting the information, making it difficult to ascertain the location of the person using the fantasy app.

Resident percentage

"Resident percentage" means, for each fantasy contest, the percentage, rounded to the nearest tenth of a percent, obtained by dividing the total amount of entry fees collected from fantasy contestants located in the State by the total amount of entry fees collected from all fantasy contestants.

Script

“Script” means a list of commands that a fantasy-contest-related computer program can execute and that are created by fantasy contestants, or by third parties for the use of fantasy contestants, to automate processes on a fantasy contest platform.

Season-long fantasy contest

“Season-long fantasy contest” means a fantasy contest offered by a fantasy contest operator that is conducted over an entire sports season.

Session

“Session” means a period of time from log-in to log-out by a fantasy contestant.

Third Party Script

"Third Party Script" is a piece of code (usually JavaScript) that is embedded on a website but is hosted on a server belonging to a company other than the website owner. This can be codes or “cheat codes” often used to determine the best grouping of players for a fantasy team or for a specific contest giving the user an unfair advantage.

 

 

 

 

Virtual Private Network (VPN)

 

 

is a technology that creates a secure, encrypted connection over the internet, essentially masking your IP address and protecting your online activity by routing your data through a remote server, allowing you to browse the web more privately and anonymously, especially on public Wi-Fi networks. VPNs can be used to conceal the true location of a user that is entering a fantasy contest, circumventing the requirement that a person playing a fantasy contest in Maine is located in Maine.
