WEEKLY NOTICES OF STATE RULEMAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rulemaking. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rulemaking if the petition is signed by 150 or more registered voters, and may begin rulemaking if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone (207) 287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." CHAPTER NUMBER AND TITLE: Ch. 280, Rules Relating to the Maine Birth Defects Program
PROPOSED RULE NUMBER: 2017-P077
BRIEF SUMMARY: This rule establishes the responsibilities of hospital administrators, physicians and other health care providers with regard to the reporting of the presence of birth defects in infants and fetuses; the confidentiality requirements of the Maine Birth Defects Program; the nature of contact between the Maine Birth Defects Program and families of children with birth defects, and the provision for parental objection to birth defect reporting or participation in the birth defect registry. These proposed changes update the reportable birth defects listing, specify specialty providers’ board certification or eligibility is the American Board of Medical Specialties, clarify wording for referral to the Part C Agency (Child Development Services) in Maine and correct a typo and grammatical errors.

AGENCY: 09-137 – Department of Inland Fisheries and Wildlife (IFW)
CHAPTER NUMBER AND TITLE: Ch. 4, Hunting and Trapping: 4.06(2), Wild Turkey (Fall Season)
ADOPTED RULE NUMBER: 2017-092
CONCISE SUMMARY: The Commissioner of Inland Fisheries and Wildlife has amended the fall wild turkey hunting season by opening Wildlife Management District 27 to turkey hunting in the fall. Only one turkey may be harvested in this district during the fall season. Wild turkeys may be harvested during the fall season with bow and arrow and shotguns of certain gauges and shot sizes only. Legal hunting time is 1/2 hour before sunrise to 1/2 hour after sunset.

CHAPTER NUMBER AND TITLE: Ch. 523, Rule Regarding Short-Form Seed Capital Registrations
ADOPTED RULE NUMBER: 2017-093
CONCISE SUMMARY: This rulemaking updates Ch. 523, Rule Regarding Short-Form Seed Capital Registrations, to simplify the Offering Circular, adjust the impoundment requirements, raise the minimum offering amount, and add basic reporting requirements.

ADOPTED RULE NUMBER: 2017-094
CONCISE SUMMARY: This rulemaking updates Ch. 536 to remove Standard & Poor’s from the list of nationally recognized securities manuals approved for use with Maine’s manual exemption at 32 MRS  §16202(2)(D), adds to the list of nationally recognized securities manuals OTCQX and OTCQB electronic markets, and creates an annual certification process for listed manuals.
